We recommend all users provide the correct information when registering for theProCardApp. It is in your interest to provide us with accurate information toenjoy the full spectrum of services we provide to you and other ProCardAppusers in the best way possible. Your account may be suspended or eventerminated if we receive five complaints about false or fraudulent informationposted on ProCardApp. A user should provide us with the correct data requiredby the Terms of ProCardApp to reopen the account.
Patents and other Copyrights protect our Services and materials incorporated byProCardApp in our Services ("Materials"). ProCardApp in our Services includes logo, additional images, and most of the characters are registered and protected as trademarks, trade names, and service marks owned by ProCardApp. ProCardApp owns the copyright and other intellectual property rights in theMaterial and Service.
You have a right to use any of our material or other content using our app.However, you cannot modify or use our Materials or any content for any purpose.Such prohibited use violates our terms and might violate the Copyrights andTrademarks protected by law.
Our application's Basic package is for everyone to use absolutely for free. If the user prefers additional Premium package options, there is a yearly fee of$9.99. It automatically applies to the user's App Store or Google Play account of an annual renewal fee for 12 months. We will notify every user of services and any additional fees added to user services and transactions that require payment. Those services will be added to our Services, Terms, and Conditions page so that everyone will have access to them.
ProCardApp might, at our sole discretion, offer products or features available at no charge for a trial period. For example, each ProCardApp user can try ourPremium account for free for 30 days.
After the 30-day trial period, a user can continue using our basic account without any charges or switch to our Premium account and pay a yearly fee of $9.99. All purchases are final and non-refundable, except as required by law. If you believe that ProCardApp has charged you in error, you must contact ProCardApp within 90 days to inform us about such a charge. No refund will be applicable after90 days of purchase. You can receive your refund by submitting a complaint letter to our team at email@example.com.
We want you and everyone else to enjoy ProCardApp as much as possible. We also want to protect all users from malicious content. At our sole discretion and without liability to us, we reserve the right to remove any material posted inProCardApp. Violators of ProCardApp’s terms and guidelines will be suspended or access to use our services terminated. If more than five ProCardApp users report an account as fake, we will block it until users provide information about the account’s legal content and real user.
If you believe that information on our platform infringes your copyrights, you may request to remove those materials (or access to them) by contacting our customer service agent at firstname.lastname@example.org.
You may only use our Service and your content for lawful purposes and by applicable law. It is prohibited to store, distribute, or transmit any unlawful material through our Service. Otherwise, you may find criminally and civilly liable. You agree that if third-party claims that material you have contributed to ourService is unlawful, you will bear the burden of establishing that it is lawful. You understand and agree that all materials publicly posted or privately transmitted on or through this Service are the sender's sole responsibility, not ProCardApp, and that you are responsible for all content you upload through this Service.
Without limitation, you agree not to send, create, or reply to so-called "mail bombs" (i.e., sending copies of a single message to many users or sending large or multiple files or messages to an individual user with malicious intent) or engage in spamming. Also, you agree not to post bulk messaging for business or other commercial purposes without written permission by ProCardApp or undertake any other activity which may adversely affect the operation or enjoyment of this Service by any other person, including placing malware on the Service.
You are responsible for all activities that occur under your User Account. You agree to notify immediately ProCardApp of any unauthorised use of yourProCardApp account or any security breach concerning your User Account.ProCardApp will not be liable for any loss that you might incur due to someone else using your User Account, either with or without your knowledge.
Using any services or facilities connected with this Service to compromise security or tamper with system resources and accounts is prohibited. In addition, the use or distribution of tools designed for compromising security (e.g.,password-guessing programs, cracking tools, malware, or network-pro bing mechanisms) is strictly prohibited. Suppose you become involved in any violation of system security. In that case, ProCardApp reserves the right to release your details to system administrators at other sites, law enforcement, and governmental authorities to assist them in resolving security incidents.
We always aspire to continue to share good vibes using ProCardApp, but you can terminate your relationship with us at any time. If you are using our free Service, you can cancel the use of this Service at any time. If you have a Premium account and you would like to discontinue using it, please be advised to cancel your subscription at least 24 hours before automatic renewal has been applied to your AppStore or Google Play account to finalise your purchase. However, you may use ProCardApp with Basic account benefits after canceling the Premium account's services. ProCardApp has the right to terminate your rights under ourService without notice where permissible under the law.
Although we make great efforts to secure our Service error and interruption-free, your use of this Service is at your own risk. No oral or written information or advice given by us shall create a warranty. The Service and materials, information, software, services, and other content is provided “as is” and “as available”without warranties of any kind. ProCardApp does not warrant that the functionality contained on or through these services will be available, uninterrupted, or error-free, defects will be corrected, or servers are free of viruses or other harmful components. ProCardApp does not warrant those materials, content posted on our Service or any websites linked to the Service regarding their correctness or accuracy. The above exclusions will apply to you only to the extent permitted by applicable law.
ProCardApp disclaims all liabilities, whether based on contract, tort (including negligence), strict liability, or otherwise, and does not accept any liability for any loss or damage (direct, indirect, consequential, or incidental) from the use of our Service.
You agree to indemnify and hold harmless ProCardApp from and against any claims, demands, liabilities, costs, or expenses, including reasonable attorney's fees, resulting from your breach of these Terms. Including any preceding provisions, representations, or warranties, from your placement or transmission of any content onto ProCardApp's servers and any use of your User Account.
ProCardApp reserves the right to modify or discontinue, temporarily or permanently, any part of this Service, with or without notice, and to establish general guidelines and limitations on their use.
You expressly agree to comply with all applicable laws concerning the transmission of technical data exported from the United States or the country where you are a resident.
ProCardApp may link you to other services provided by third-party partners cooperating with us to offer you certain Services. ProCardApp is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of any of those sites you might use. The inclusion of any link does not imply any site endorsement by ProCardApp or any association with its operators.
ProCardApp cannot ensure that you will be satisfied with any products or services you use or purchase from any third-party site that links from ProCardApp since the third-party sites are owned and operated by independent retailers. ProCardApp does not endorse any of the merchandise, nor has it taken any steps to confirm the accuracy or reliability of the information contained on third-party sites.ProCardApp does not make any representations or warranties about the security of any information (including, without limitation, credit card and other personal information) you are required to give any third party, and you irrevocably waive any claim against us. We strongly encourage you to make whatever investigation you feel necessary or appropriate before proceeding with any online transaction with any of these third parties to protect your information.
To the extent permitted by law, and except for Section 8, these Terms shall be governed by, construed, and enforced by the State of Florida's requirements, as they are applied to agreements entered and performed entirely within Florida.
This section sets forth the particular way you can resolve any dispute you might have with us. If you ever wish to seek relief from us, you agree to do it only through arbitration, and you waive the ability to pursue a class action.(a)U.S. Residents: To the fullest extent permissible by law, except for disputes of ProCardApp's intellectual property rights and specific statutory claims that, according to law, are not arbitrable. Any discussion of any kind between you and ProCardApp arising under these Terms shall be resolved through binding arbitration according to the Arbitration Rules and Procedures on an individual basis with no class relief. The arbitrator shall be a retired judge or justice of any Florida state or federal court with substantial experience in the internet industry and shall follow Florida substantive law in adjudicating the dispute. You and we agree that we intend that this Section 8(a) satisfies the"writing" requirement. The hearing should take place in the county that encompasses the billing address you have provided to ProCardApp. For any claim in which you seek the U.S. $10,000.00 or less, you shall choose whether the hearing is in person, by telephone, or the arbitrator can decide the dispute without a hearing. ProCardApp agrees that it will not seek reimbursement from you for its costs and expenses incurred in the arbitration. (b)Non-U.S. Residents: If any controversy, allegation, or claim (including any non-contractual claim) arises out of or relates to the Service or the Terms (a "Section8(b) Dispute"), then you and we agree to send a written notice to the other providing a reasonable description of the Section 8(b) Dispute, along with a proposed resolution of it, and will forward our correspondence to you based on the recent contact information you provide us. But if no such information exists or if such information is not current, we have no obligation under this Section 8(b). You must send your notice to us at email@example.com.For sixty (60) days from the date of receipt of information from the other party, you and ProCardApp will engage in a dialogue to attempt to resolve theSection 8(b) Dispute. However, nothing will require either you or ProCardApp to address Section 8(b) Dispute on terms that either you or ProCardApp are uncomfortable in each of our sole discretion. If your Section 8(b) dispute against ProCardApp involves a paid Services and we cannot resolve it through dialogue (as described above), ProCardApp willDirective 2013/11/E.U. on Consumer Alternative Dispute Resolution. You can findEuropean Commission Online Dispute Resolution ("ODR") ateu.europa.eu/odr.
